Delta-9 THC Derived from Hemp

Delta-9 THC is traditionally known as the primary psychoactive component found in marijuana, which is responsible for the ‘high’ experienced by users. While both marijuana and hemp are forms of the Cannabis sativa plant, they are regulated under different legal frameworks in the United States.

Under the 2018 Farm Bill, hemp was legalized at the federal level and is defined as any Cannabis sativa plant with a THC content of no more than 0.3% on a dry weight basis. This definition includes all parts of the plant, including seeds and all derivatives, extracts, and cannabinoids.

It’s important to note that while delta-9 THC is also present in hemp, it must be below the 0.3% threshold to comply with federal law. Some innovative producers have developed hemp-derived products that contain delta-9 THC at levels that do not exceed this limit per unit of dry weight. These products are technically legal under federal law as long as the total delta-9 THC does not surpass 0.3% of the product’s dry weight.

However, the legality of marketing and selling delta-9 THC products derived from hemp that are intended to induce psychoactive effects remains a grey area and varies by state. Even in states where recreational use of marijuana is legal, products containing delta-9 THC derived from hemp must be carefully regulated to ensure compliance with both state and federal law.
